GENERAL AND IRREVOCABLE MODEL RELEASE
The purpose of this Agreement is to discharge, ELITEMATE.COM LLC -
You Can Swing It, its heirs, executors, administrators, agents, principals, individual and corporate successors,
assigns and licensees from any and claims arising out of the use of your name, pictures, exhibits,
likeness, biographical materials and representations concerning you. The subject matter of this
Release will be utilized, without limitation, for dissemination in and for purposes of trade
and otherwise in connection the advertising, marketing and promotion
of the aforementioned individuals and/or entities.
1. Model irrevocably grants ELITEMATE.COM, its heirs, executors, administrators,
agents, principals, individual and corporate successors, assigns and licensees,
the right to use and allow others to use and disseminate Model's name, pictures,
exhibits, likeness, biographical materials and representations in any and all medium
now in existence or hereinafter discovered in perpetuity.
2. Model expressly understands that the items subject to this Release will be published
commercially and utilized for purposes of trade. More specifically, said items will be used,
without limitation, in conjunction with the advertising, marketing and promotion of ELITEMATE.COM,
its heirs, executors, administrators, agents, principals, individual and
corporate successors, assigns and licensees.
3. It is further understood that ELITEMATE.COM, its heirs, executors, administrators,
agents, principals, individual and corporate successors, assigns and licensees shall
have the irrevocable right to copy and reproduce the performances embodied in the
items referenced herein by any method now known or hereinafter discovered.
This shall include the right to utilize, or refrain from use, such performances in
conjunction with any Trademark, Trade-Names, or Labels designated by us in our sole discretion.
4. For and in consideration of the sum of One Dollar and such other good and valuable
consideration, the sum and sufficiency of which is hereby acknowledged as received by
Model, Model hereby irrevocably releases, discharges, indemnifies and holds harmless
ELITEMATE.COM, its heirs, executors, administrators, agents, principals, individual and
corporate successors, assigns and licensees from all actions, causes of action, suits, debts,
dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts,
controversies, agreements, promises, damages, judgements, executions, claims and
demands whatsoever, in law or at equity, which Model or its heirs, executors, administrators,
agents, principals, photographers, individual and corporate successors, assigns and/or
licensees ever had, now have or hereinafter can, shall or may, have for, upon, or by reason
of any matter, cause or thing whatsoever from the beginning of the world to the day of
this Release pertaining to the use and/or dissemination of Model's name, pictures,
exhibits, likeness, biographical materials and representations.
5. Model irrevocably warrants that they have not assigned or licensed any claim,
right or privilege covered under this release to any Third Party not expressly stated herein.
6. Model further states that the foregoing has been read and Model knows the contents hereof.
This Release has been signed by Model's own free act. This release may not be changed orally.
